The property documents checklist deserves a place beside your budget and preferred location when buying a flat in India. Before paying a booking amount, establish who can legally sell the home, what has been approved, how much you will actually pay and when you can move in.

A sample flat can help you picture everyday life, but it cannot answer questions about ownership, outstanding loans or possession conditions. Those answers come from records, written agreements and independent checks. This guide takes you through the documents and practical decisions to review from shortlisting to handover.

Start with the Type of Flat You Are Buying

An under-construction apartment, a completed builder flat and a resale home require different checks. Identify the purchase type before collecting paperwork.

For an under-construction flat, focus on the registered project phase, approvals, construction progress and agreement terms. For a completed apartment, check the applicable completion and occupancy documents. For resale, also establish the seller's ownership, mortgage position, maintenance dues and authority to transfer the flat.

Create a folder for each shortlisted property. Record the source and date of each document, along with questions that remain unanswered. This makes comparisons easier when different sales teams provide information in different formats.

Check RERA Details and the Seller's Authority

Where project registration is required, search the relevant state RERA portal yourself. Match the promoter, project phase and location with the apartment being offered. Review the disclosed completion date, progress updates, extensions and available orders. An agent's registration number is separate from a project's registration. [1]

Treat RERA records as one part of verification. Ask an independent property lawyer to examine title and the seller's authority. In a joint development project, the landowner may retain ownership while granting development and sale rights. The lawyer should establish which party can sell your particular apartment.

Do not rely solely on a developer's reputation or a lender's project approval. Ask for the underlying documents and resolve inconsistencies before committing money.

Property Documents Checklist Before Booking

Document names and requirements differ across states. Use the following checklist to organise your review, with a local property lawyer confirming what applies.

Document or record

What to establish

Title documents and ownership chain

How ownership passed to the present owner and whether the seller has transferable rights.

Joint development agreement and power of attorney, where relevant

Whether the developer or representative is authorised to sell the specific unit.

Encumbrance Certificate or relevant registration search

Recorded transactions and encumbrances for the property and search period.

Land-use and conversion records, where applicable

Whether the proposed residential use is permitted.

Sanctioned plans and construction permissions

Whether the offered building, floor and apartment correspond to approved plans.

Project-specific clearances, where applicable

Required fire, environmental and other approvals, including their coverage and validity.

Project RERA records, where applicable

Whether the registration relates to the correct project phase.

Draft agreement for sale and allotment terms

What you are buying, payment obligations, possession terms and cancellation conditions.

Tax records and payment receipts

Whether property details are consistent and outstanding dues need settlement.

Mortgage release or lender consent, where applicable

How an existing charge affecting the apartment will be released.

Completion and occupancy documents for completed buildings

Whether the applicable certificates cover the relevant building or phase.

An Encumbrance Certificate reflects registered transactions within the searched period. A nil EC should therefore not be treated as proof that every possible claim or dispute has been ruled out. Ask your lawyer whether additional searches are needed. [2]

For resale purchases, also request the seller's acquisition deed, available original documents, loan closure records and association dues statement. Where ownership arises through inheritance, representation or a company, obtain the additional supporting records your lawyer identifies.

Prepare your own identity, address and PAN records, along with the income and banking documents your lender requests. Confirm the registration office's requirements for co-buyers, witnesses and any authorised representative in advance.

Review the Agreement Before Increasing Your Payment

Check the apartment number, floor, carpet area, specifications, land share where applicable and parking rights against the offer you accepted. Review the payment milestones, possession date, cancellation deductions, refund process and treatment of delayed payments.

For transactions covered by RERA, a promoter cannot collect more than 10% of the apartment cost as an advance or application fee before entering into and registering the agreement for sale. [3]

Ask your lawyer to explain delay remedies under the applicable state rules. Avoid assuming that one interest formula applies uniformly across India. Include material promises about fittings, amenities and delivery in the contractual documents; retain brochures and written correspondence.

Check whether payments follow actual construction milestones and how the lender will release funds. Keep a receipt for every payment and confirm the authorised beneficiary account before transferring money.

Calculate the Full Cost of Buying the Flat

Request an itemised cost sheet before comparing offers. It should distinguish the apartment price from taxes, statutory charges, deposits and optional purchases.

  • Budget for the following, where applicable:
  • Stamp duty, registration fees and local levies.
  • GST, with the applicable basis explained in writing.
  • Disclosed charges for amenities, preferential location and lawful parking arrangements.
  • Maintenance advances, corpus contributions and utility deposits.
  • Loan processing, valuation, legal review and mortgage-related expenses.
  • Interiors, moving costs and an emergency reserve.

Stamp duty and registration charges depend on the state and transaction. Bengaluru buyers can use our Karnataka stamp duty guide to understand the components before checking the official calculation for their purchase.

GST also needs a transaction-specific check. The construction-service rule excludes a sale where the entire consideration is received after the completion certificate, where required, or first occupation, whichever is earlier. A description such as "ready to move" does not establish that timing by itself. [4]

For a home loan, obtain the lender's written terms covering eligibility, disbursement, interest resets and fees. Assess repayments alongside existing commitments, maintenance and possible rent during construction. Ask a tax professional to confirm any buyer withholding obligations before the relevant payment, particularly if the seller is non-resident.

Understand the Area and Test the Location

RERA carpet area includes internal partition walls but excludes external walls, service shafts, exclusive balconies or verandahs and exclusive open terraces. Ask for an area statement separating these components. [3]

Our guide to super built-up area explains the terms buyers commonly encounter. Compare shortlisted flats using a consistent area basis, then assess whether the actual room dimensions work for your furniture and household.

Visit the neighbourhood during your likely commuting hours. Check road access, public transport, water arrangements, drainage, construction activity and nearby essentials. Ask residents about practical issues such as water interruptions, noise and maintenance responsiveness.

For proposed infrastructure, distinguish an announcement from an approved, funded or operational project. Evaluate whether the home suits your needs with today's connectivity, particularly if a future road or metro line is central to the sales pitch.

Assess the Builder and the Cost of Upkeep

Visit completed projects from the same developer where possible. Ask residents about possession, defect repairs, billing transparency and the transition to association management. Review available regulatory orders alongside customer feedback, and distinguish unresolved complaints from concluded cases.

For amenities, establish what belongs to your phase, what is shared and when access begins. Ask for a maintenance estimate explaining the area used for billing, included services and separately charged items.

Get parking terms in writing, including the space or allocation process and the nature of your rights. Ask your lawyer to review those terms under the applicable rules rather than assuming that every parking space can be sold independently.

Flat Handover Checklist Before Moving In

Arrange an inspection of the actual apartment, preferably with a qualified professional for technical checks. A visual walkthrough alone cannot confirm structural integrity or electrical safety.

Inspect accessible plumbing, drainage, doors, windows, flooring and visible signs of seepage. Compare installed fittings and finishes with the agreed specifications. Record defects with dated photographs and obtain a written rectification schedule.

RERA provides a five-year window from possession for notifying specified defects and requires the promoter to rectify covered defects without charge within 30 days. Preserve inspection records and written notices. [1]

For a completed building, verify the applicable occupancy approval and its coverage before moving in. A possession letter should not be treated as a substitute for that approval. [3]

Collect or confirm custody of:
  1. The registered sale or conveyance deed and agreement for sale.
  2. Applicable completion and occupancy certificates or accessible certified records.
  3. Payment receipts, final account statement and relevant tax records.
  4. Mortgage release documents where an existing charge affected the flat.
  5. Possession record, keys, meter details and equipment warranties.
  6. Parking allocation and maintenance contact details.
  7. Association membership or transfer records, as applicable.

If a lender retains original documents, obtain its acknowledgement and document list. Do not sign an unqualified statement that all defects are resolved when work remains outstanding.
